Virginia voters will decide on four proposed constitutional amendments in the November 2026 general election, following approval by both chambers of the General Assembly in consecutive legislative sessions.
Abortion and Reproductive Rights (HJ1)
Would enshrine a fundamental right to reproductive health care, including access to abortion, contraception, and fertility treatments, in the Virginia Constitution.
Automatic Restoration of Voting Rights (HJ2)
Would automatically restore voting rights to individuals who have completed their felony sentences, eliminating the current system where the Governor must individually restore rights through discretionary action. This applies to all citizens not incarcerated for a felony.
Marriage Equality (HJ3)
Would repeal the existing constitutional ban on same-sex marriage, which was effectively nullified by the U.S. Supreme Court in Obergefell v. Hodges (2015), and affirm equal treatment for all marriages under state law.
Mid-Decade Redistricting (HJR6007)
Would allow the General Assembly to redraw congressional and legislative district boundaries between decennial censuses, enabling redistricting to address legal or demographic changes outside the traditional 10-year cycle. This amendment is being advanced to ensure fair maps for the 2026 congressional elections.
These amendments require two consecutive legislative approvals and a majority vote by Virginia voters to take effect. The final votes in both the House and Senate were passed in January 2026, with the amendments scheduled for the November 3, 2026 statewide ballot.
